# How to Check if Your Brand Is Registered in China

Before you print packaging or launch a listing, check whether your brand is already registered in China. The search is free, but the result is not a simple yes or no. You need to check the word, the logo, the Chinese name and the class that matches your product.

## What “registered in China” actually means

A Chinese trademark is territorial. A US, UK or EU registration does not appear in the China register as a Chinese right. The owner may have filed a separate China application, or may rely on an international registration designating China. The search should look for the Chinese record, not the home registration.

The register is organized by class and goods or services. A mark can be registered in Class 25 for clothing and still be available in Class 9 for software. That does not mean the other use is safe. A similar mark in a related class can still create confusion, and a famous mark can have broader protection. The class is the starting point, not the whole analysis.

## Search the word, the logo and the Chinese name

Start with the exact word mark. Then search near spellings, plurals, hyphens, spaces and common visual variants. If your brand is a made-up word, check the most likely misspellings. If it is a dictionary word, check the Chinese translation and the transliteration that customers actually use.

Search the logo separately. A logo search is not the same as a word search. The examiner compares the visual elements, the overall impression and the goods. If the logo contains a distinctive device, search that device as well as the words. If the logo is a simple word in a standard font, the word search may be enough for a preliminary check.

Chinese characters deserve their own search. Many foreign brands use an English name online and a Chinese name on packaging, in marketplace listings or in retail. If the Chinese name is already registered by someone else, the English registration may not solve the customer confusion. Search the exact characters, common variants and the pinyin.

## The CNIPA search in practice

- Open the CNIPA trademark search system and choose the trademark search function.

- Enter the word or image and select the relevant class.

- Review identical marks first, then similar marks in the same class and related classes.

- Check the status. A pending application, a registered mark and a cancelled mark have different implications.

- Record the application number, owner, filing date, class and goods list for every close result.

The free system is useful for a first pass, but it has limits. The classification language is technical. Similarity is not a simple text match. A mark that looks different can still be confusingly similar, and a mark in a different class can still block you if the goods are related. For a launch decision, a professional search should review the results and explain the risk.

## How to read the results

| Result | What it usually means | Next step |
| --- | --- | --- |
| Identical mark, same class, same goods | High risk | Choose a different name or prepare a narrow filing strategy |
| Similar mark, same class | Moderate to high risk | Compare the goods list, the visual impression and the owner’s use |
| Identical mark, unrelated class | Lower risk, but not zero | Check whether the goods are related and whether the mark is famous |
| Pending application with a later filing date | Possible conflict, timing matters | Monitor publication and consider opposition if it proceeds |
| Cancelled or expired mark | May be available, but check the cooling period | Confirm the status and the refiling rules before filing |

A clean search is not a guarantee of registration. It means the register does not show an obvious block. The examiner still reviews distinctiveness, descriptiveness, similarity and the goods list. A mark that is clean in the register can still be refused on absolute grounds.

## When a free search is not enough

Run a deeper search when the brand is central to the launch, when the class is crowded, when the mark is a short word, when the Chinese name is important, or when you have already received a warning letter. A deeper search may include multiple classes, related goods, Chinese transliterations, device elements and the owner’s other filings.

The most expensive mistake is not a failed search. It is a failed launch. Packaging, marketplace listings, photography and advertising all carry the brand. If the name has to change after launch, the cost is not just the new filing. It is the reprint, the lost reviews and the customer confusion.

## Search the class, not just the name

A name search without a class is incomplete. The same word can be registered by different owners in unrelated classes. A clothing brand and a software company may coexist under the same name if the goods and services are far enough apart. The search result only becomes useful when you connect it to the product you sell.

Start with the core product class. Then check the service class that matches the sales channel. A clothing seller may need Class 25 for the garments and Class 35 for the storefront. A cosmetics seller may need Class 3 and Class 5. A technology brand may need Class 9 and Class 42.

Also check related goods. A mark registered for bags in Class 18 may be relevant to a clothing brand in Class 25 if the products are sold together and share the same customers. The examiner looks at the goods, the trade channels and the consumers, not only the class number.

## Document what you find

For every close result, record the application number, the owner, the filing date, the status, the class and the goods list. Take a screenshot with the date visible. If the result is a similar mark, write one sentence explaining why it is close: same word, similar pronunciation, similar Chinese characters, same product, same customer group.

This record does two things. It helps you compare the risk across several marks. It also gives your agency or lawyer a clear starting point. A list of ten screenshots without notes is less useful than a table with the key facts.

## What to do if the mark is already taken

First, check whether the owner is using the mark. A registration with no use may be vulnerable to non-use cancellation after three years, but that is a separate proceeding with its own timeline and evidence. Do not assume an unused registration can be ignored.

Second, compare the goods. A narrow goods list may leave room for a different product line. Third, consider a coexistence agreement if the owner is willing. Fourth, consider a different name or a different Chinese name. Finally, if the other side has filed in bad faith, an opposition or invalidation may be available.

## Frequently asked questions

### Is the CNIPA search free?

Yes. The public search is free. A professional search charges for the review, the class analysis and the written risk note, not for access to the register.

### Can I search without a Chinese company?

Yes. The public search does not require a Chinese entity. A foreign applicant can search before deciding whether to file.

### How far back should I look?

Look at live registrations and pending applications first, then review expired or cancelled marks for context. A mark that has been abandoned may still have residual goodwill or a refiling risk.

## Search before you name the product

The best time to search is before the name goes on a sample, a box or a listing. The second-best time is before the first order. The longer the brand is in market, the more expensive a change becomes.
