The official China trademark timeline
China National Intellectual Property Administration (CNIPA) publishes its examination targets, and a straightforward application usually flows like this:
- Filing (day 0). Your licensed Chinese agency submits the application and you receive an application number immediately.
- Formal examination (about 1 month). CNIPA checks whether the documents are complete and issues a filing receipt.
- Substantive examination (about 4 months). CNIPA searches for conflicting marks and checks the mark against prohibited grounds. This is the stage where most refusals are issued.
- Registration (about 7 months total). If the mark passes, CNIPA publishes it, waits for the opposition window, and issues the certificate.
What can make it longer
Three events commonly stretch the timeline:
- An office action or refusal. A refusal adds months. We have handled responses that turned an initial refusal into a registration; the same response, left unfiled, ends the application. This is why our Standard plan includes one response.
- An opposition. After publication, anyone can oppose during the window, and squatters do. An opposition typically adds 6 to 12 months or more.
- Priority or assignment issues. Claims of priority under the Paris Convention or ownership changes slow the process down.
Why speed matters in China
China is a first-to-file country. The first person to file a mark, even in bad faith, gets priority. Every month without a filing is a month in which a squatter can register your brand, block your sales, and demand payment. If you plan to sell in China, file before you launch, not after a problem appears.
