Design Patent for Packaging: Protect Your Box Before It Gets Copied

Packaging counts as a design in China. If your box or bottle has a distinctive look, a design patent protects it, and brands that skip it often discover the copycat was copying the packaging first.

Why packaging matters

Buyers recognize products by the box before they touch the product. A lookalike package on a shelf or listing confuses customers and transfers trust to the copycat. The design patent gives you the right to stop that confusion.

What to file

File the packaging itself: the six views of the box, bottle or label layout that makes it recognizable. If the product and the packaging are both distinctive, file them as separate applications, because the rights are separate.

Common mistakes

  • Filing the logo inside the packaging as if it were the design
  • Mixing photos and renders in one application
  • Forgetting the top and bottom views

How to start

Send us photos of your packaging and we will check whether it qualifies and which views you need. The filing itself runs through our design patent service, and most grants land within 6 to 12 months. Ask us before your next production run, because designs filed before manufacturing are the cleanest ones.
