Product Copied in China? How a Design Patent Stops It

If your product is being copied in China, a granted design patent is the fastest legal lever you have: it supports platform takedowns, customs seizures and factory-level action. Without it, most complaints stop at the front desk.

Step one: document the infringement

Save the listings, photos, order details and factory correspondence. Evidence decides everything downstream, so collect it before you announce anything.

Step two: use the registered right

  • Platform complaint. Your registration number plus evidence is usually enough to start a takedown.
  • Customs recordal. If goods are shipping in volume, border enforcement stops them before they reach buyers.
  • Factory action. A cease-and-desist through local counsel is faster than most sellers expect.

If you do not have the patent yet

File immediately. China grants design patents in 6 to 12 months, and the filing date is what counts for priority. While it is pending, your options are limited, so treat every day as expensive. Our design patent service includes the image compliance check that gets applications through the first time, and the contact page is the fastest way to start.
