If you sell a physical product in China or source from Chinese factories, a China design patent is the most practical anti-copying tool you can own. It protects the appearance of your product and gives you the legal basis to stop lookalikes at marketplaces, borders and factories.
What a China design patent protects
A design patent covers the visual appearance of a product: its shape, pattern, color, or a combination. It does not protect how the product works; that is an invention or utility model patent. For most consumer products, appearance is exactly what copycats steal first.
How sellers use it on Temu, Shein and Amazon
- Platform takedowns. A granted Chinese patent is strong evidence for takedown requests when a lookalike listing appears.
- Customs enforcement. Recorded with China Customs, your patent lets customs intercept counterfeit exports at the border.
- Factory control. If a factory makes an extra run of your product, your patent gives you the right to stop it.
Timeline and cost
Design patents are not substantively examined in China, which keeps the grant rate high and the process fast. CNIPA typically grants a design patent within 6 to 12 months; in our experience, simple products land closer to the shorter end. National route or Hague system?
Since 2022, foreign applicants can also protect designs in China through the WIPO Hague system. For a one-country filing, we usually recommend the national route; Hague earns its keep when you need several countries at once. We compare both for your situation before recommending one.
